Terms of Service
Last updated: March 7, 2026
1. Acceptance of Terms
By accessing or using the Electric Evolution E-Bikes website (electricevo.com) and any related services, you agree to be bound by these Terms of Service. If you do not agree to all of these terms, please do not use our website or services.
2. Description of Services
Electric Evolution E-Bikes is a family-owned, locally operated retailer and authorized dealer/distributor located in New Braunfels, Texas, specializing in the sale, service, and repair of electric bikes, electric motorcycles, and electric scooters. Our website provides product information, online purchasing capabilities, service scheduling, and general information about our business.
3. Online Purchases
All purchases made through our website are subject to product availability. We reserve the right to refuse or cancel any order for any reason, including errors in product or pricing information.
Prices displayed on our website are in US dollars and are subject to change without notice. We make every effort to ensure pricing accuracy, but errors may occasionally occur.
As a locally owned and operated electric bike shop, we do not offer shipping services at this time. However, we understand that transportation and convenience are important factors when purchasing an electric bike. We are happy to discuss potential delivery options for customers located within our local area. If you are interested in arranging delivery, please contact us directly to explore available options and associated costs.
4. Manufacturer Warranties, Dealer Disclaimer & Delivery Terms
Electric Evolution E-Bikes operates as an authorized dealer and distributor for the brands and products we carry. We do not offer general shipping services (see Section 3); however, products may in some circumstances be delivered via a carrier through a local delivery arrangement or fulfilled directly by a manufacturer. The following terms apply to all such situations, as well as to all product warranty matters.
Manufacturer Warranties. All product warranties, guarantees, and representations are provided solely by the respective manufacturer. As a dealer and distributor, Electric Evolution E-Bikes makes no independent warranty, express or implied, regarding any product. For all warranty claims, defects, or product-quality issues (including but not limited to dead-on-arrival (DOA) units, manufacturing defects, missing components, and product malfunctions), you must contact the manufacturer directly. Warranty documentation is included with your product or available from the manufacturer’s website.
Shipping & Delivery. Once an order leaves our facility or is tendered to a shipping carrier, responsibility for the safe and timely delivery of that order transfers to the carrier. Electric Evolution E-Bikes is not responsible for delays, losses, damage in transit, or any other issues that occur during shipping. All shipping-related claims — including lost packages, damaged freight, and delivery disputes — must be filed directly with the applicable shipping or freight carrier.
Missing Parts & DOA Products. If your product arrives with missing parts or is dead-on-arrival, please contact us within 7 days and we will help facilitate a resolution with the manufacturer. Missing-parts and DOA claims are handled under the manufacturer’s warranty or support policy. While we will assist in facilitating communication on your behalf, Electric Evolution E-Bikes bears no independent financial or legal responsibility for resolving such claims.
Our Role. We are a dealer and distributor — not the manufacturer or shipping carrier. Our role is to connect customers with quality products. Any issues relating to product defects, warranties, delivery failures, missing components, or DOA merchandise are the responsibility of the manufacturer and/or the shipping company, respectively, and are outside our direct control or liability.
5. Returns, Refunds & Exchanges
No Returns — All Sales Are Final
At Electric Evolution E-Bikes, we are committed to providing high-quality products and excellent service. Due to the nature of our products, we do not accept returns on any purchases. All sales are considered final. We encourage you to reach out with any questions before making a purchase to ensure you select the right product for your needs.
Damages and Issues
If you receive a defective, damaged, or incorrect item, please inspect your order upon arrival and take photos as documentation, then contact us within 7 days of delivery at info@electricevo.com. We will assess the issue and work with you to find a suitable solution, which may include repair, replacement, or store credit.
Support and Warranty
We stand by our products and offer support to ensure your satisfaction. All product warranties are provided by the manufacturer, not by Electric Evolution E-Bikes. As a distributor, we will assist with the warranty process on your behalf, but the warranty is ultimately between the customer and the manufacturer. Warranties may differ from brand to brand. Please note that we do charge for labor if the manufacturer does not provide reimbursement. For warranty assistance or any other issues, please reach out to us at info@electricevo.com.
Exchanges
We generally do not offer exchanges at this time. If an item is still in mint condition and you would like to exchange it for an item of equal or greater value from Electric Evolution E-Bikes, please contact us and we would be happy to discuss options. Any difference in price must be paid at the time of exchange. All exchanges are on a case-by-case basis and completely at the discretion of our staff.
6. Test Rides & In-Store Services
We offer test rides at our showroom location. By participating in a test ride, you acknowledge that riding an electric bike, motorcycle, or scooter carries inherent risks. You agree to follow all safety instructions provided by our staff, wear appropriate safety gear, and ride responsibly.
You are responsible for any damage to the vehicle caused during your test ride due to negligence or misuse.
7. Post-Purchase Rider Safety, User Responsibility & Legal Compliance
Once a product has been purchased and leaves our possession, the buyer assumes full responsibility for its safe and lawful operation. Electric Evolution E-Bikes is not responsible for any accidents, injuries, property damage, mechanical failures, flat tires, or any other incidents that occur after the point of sale, whether arising from normal use, user error, negligence, or improper operation.
Lawful Use. It is the sole responsibility of the buyer to understand and comply with all applicable local, state, and federal laws governing the use of electric bikes, electric motorcycles, electric scooters, and any other products we sell. This includes, but is not limited to, laws regarding speed limits, permitted riding areas, helmet requirements, licensing, and registration. Electric Evolution E-Bikes is not responsible for any citations, fines, penalties, legal proceedings, or other consequences arising from the unlawful or improper use of any product purchased from us.
No Post-Sale Liability. By completing a purchase, you acknowledge that Electric Evolution E-Bikes bears no liability for events occurring after delivery or pickup of your product, including but not limited to accidents, personal injury, property damage, traffic violations, or any legal action resulting from the use or misuse of the product.
8. Service & Repairs
Estimates & Approvals. Service and repair estimates are provided as good-faith approximations based on the scope of work at intake. We make every effort to discuss the expected scope and costs with you upfront before any work begins. If the actual work required causes the total to exceed the original estimate by more than 50%, we will stop and contact you for approval before proceeding further.
Labor & Parts Pricing. Labor is billed at our standard hourly rate. Parts are charged at flat cost with no overhead or markup — you pay exactly what we pay for the part.
Unclaimed Vehicles & Abandonment. Once service or repairs are complete, we will notify you via your provided contact information. Vehicles must be retrieved promptly. If a vehicle remains unclaimed for more than 45 days following completion and we have made six (6) or more documented contact attempts through varying methods (phone, email, and/or certified mail to your last known address), the vehicle will be deemed abandoned. Electric Evolution E-Bikes reserves the right to assert a mechanic’s lien and pursue all remedies available under Texas Occupations Code Chapter 2305 and applicable Texas law, including sale or disposal of the vehicle to recover outstanding charges. Storage fees may accrue on unclaimed vehicles.

- Interfere with or disrupt the website or servers connected to the website
- Submit false or misleading information through any forms on the website
11. Limitation of Liability
Electric Evolution E-Bikes and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use our website or services.
Our total liability for any claim arising from or related to these terms shall not exceed the amount you paid to us for the specific product or service giving rise to the claim.
12. Disclaimer of Warranties
Our website and services are provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components. For product warranty information, please refer to Sections 4 and 5 of these Terms.
13. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Comal County, Texas.
14. Changes to Terms
We reserve the right to update or modify these Terms of Service at any time without prior notice. Changes become effective immediately upon posting to the website. Your continued use of the website following any changes constitutes your acceptance of the revised terms.
